2. The petitioner apprehends his arrest in connection with N.H. Bangra P.S. Case No. 132/ 2025 registered for the offence(s) punishable under section(s) 115(2), 126(2), 118(1), 303(2), 109(1), 352, 351(1) and 3(5) of the BNS.

Learned senior counsel for the petitioner submits that this is the second attempt by the petitioner to get the relief of anticipatory bail and his first prayer was rejected vide order dated 17.02.2026 passed in Cr. Misc. No. 7962 of 2026, though, the prayer of the other accused persons made in the same application was allowed mainly considering the nature of the allegation appearing against the petitioner as he assaulted the informant on his leg with an iron rod and at the time of deciding the petitioner's first prayer, the final medical opinion with regard to the nature of

No.47740 of 2026(2) dt.31-07-2026 2/3 the injuries sustained by the informant was not available as the same had been reserved which was taken into consideration by this Court while rejecting the petitioner's first prayer and now, the petitioner has renewed his prayer as the final medical opinion has since been received which shows that all the injuries sustained by the informant including the injury specifically attributed to the petitioner, have been opined to be simple in nature and in this regard, Annexure-P/4 may be perused.
Learned senior counsel further submits that as per the injury report, the informant sustained eight injuries but out of which seven were in the nature of pain except one injury which was found in the nature of incised wound over the left ring finger, however, the same has not been attributed to the petitioner but even then the weapon used has been described as a hard and blunt object. It is further submitted that petitioner bears no criminal antecedent and other accused persons carrying almost similar nature of allegations have been granted the relief of anticipatory bail and further, before registration of the FIR of the present matter, N. H. Bangra P.S. Case No.
131 of 2025 had been lodged by the petitioner against the prosecution party on account of the assault committed upon the petitioner's son and only thereafter the FIR of the present matter was registered.
4. Though, learned APP appearing for the State opposes
Patna High Court CR. MISC. No.47740 of 2026(2) dt.31-07-2026 3/3 the prayer of the petitioner but has not shown any requirement of petitioner's interrogation by the police in the present matter.

Considering the above submissions as well as facts and circumstances of this case and mainly taking into account the nature of the injuries of the informant which was not available before this Court at the time of deciding the petitioner's earlier prayer and the same shows that the informant who is sole injured of the present matter sustained simple injuries coupled with the petitioner's fair and clean antecedent, this Court is now inclined to grant the relief of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with N.H. Bangra P.S. Case No. 132/ 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the BNSS.
