====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-07-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Kalyanpur P. S. Case No. 50 of 2026 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, total 825.600 liters illicit liquor was recovered from the hut and bamboo orchard of this petitioner and co-accused Shatrudhan Chaudhary.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Similarly situated co-accused, namely, Shatrudhan Chaudhary has already been granted regular bail by

Patna High Court CR. MISC. No.50984 of 2026(2) dt.31-07-2026 2/2 co-ordinate Bench of this Court vide order dated 05.05.2026 passed in Cr. Misc. No. 30485 of 2026. Petitioner is in custody since 02.05.2026.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation, period of custody and claim based on parity, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.-3, Motihari, East Champaran in connection with Kalyanpur P. S. Case No. 50 of 2026.
