JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-12-2013 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,323,324,307,447 and 504 of the Indian Penal Code. The specific accusation of assault with axe to the son of the informant is against Suresh Yadav petitioner No.3 when informant was assaulted with axe by petitioner no.5, Prabhu Yadav.
It is submitted by learned counsel for the petitioners that a statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Let the learned court below consider the regular bail of the petitioner nos. 3 and 5 without being prejudiced by the order of this Court if they surrender within a period of six weeks. Accordingly the application with regard to petitioner
Patna High Court Cr.Misc. No.39115 of 2013 (2) dt.24-12-2013 2/2 nos. 3 and 5 is disposed off.
So far as petitioner nos. 1, 2, 4 and 6 are concerned, the accusation is not specific against them, let them be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sherghatti, Gaya in connection with Imamganj P.S. Case No. 94 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/-
