JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-12-2018 Having regard to the fact that there is criminal antecedent against this petitioner, the Court is not inclined to grant anticipatory bail. Accordingly, the prayer for anticipatory bail is rejected. However, refusal to anticipatory bail will not cause prejudice to the petitioner.
In the even, the petitioner surrenders before the court below and prays for regular bail, the court below is directed to dispose of the application for regular bail on the same day without being influenced by the refusal of the anticipatory bail. The court below is also directed to consider the fact that similarly circumstanced other co-accused have been granted bail.
