ANJANA MISHRA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 420/409 of the Indian Penal Code.
Learned counsel for the petitioner submits that he is willing to pay 20% of the alleged defalcated amount of Rs. 50,17,395.80. He submits that the said amount shall be deposited by him by 31st of March, 2017 as he is trying to make arrangements for payment of the said amount. He further submits that with regard to the said amount, he is willing to appear before the Bihar State Food and Civil Supplies Corporation for calculation and determination of the exact figures. As such, let the petitioner abovenamed, in the
Patna High Court Cr.Misc. No.32639 of 2016 (2) dt.23-12-2016 P2/2 event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-cum-Sub-Judge 1st, Muzaffarpur in connection with Kazi Mohammadpur P.S. (Muzaffarpur) Case No. 52 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. It is made clear that if the petitioner does not make payment of the said amount of 20% within the time as indicated by him and stated in this order, it shall be open to the Bihar State Food and Civil Supplies Corporation to take appropriate steps in accordance with law.
