This is a petition for grant of anticipatory bail for offence under Section 306 of the Indian Penal Code. Wife of the informant committed suicide on 27.07.2016. The petitioner is a neighbour of the informant and allegation is that since the petitioner was having illicit relationship with the wife of the informant, the victim committed suicide. Apparently there is no material to substantiate that the petitioner had abetted the suicide nor there was any reason for the petitioner to abet for the suicide.

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Katihar Town P.S. Case No. 494 of 2016 to the satisfaction of the Chief Judicial Magistrate, Katihar, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
