This application for regular bail in NDPS Gr. No. 71 of 2020, arises out of Hajipur Town P.S. Case No. 419 of 2020, disclosing the offence punishable under Sections 20, 22, 23, 27, 27(A), 29 of the NDPS Act, Sections 399, 402 of the Indian Penal Code and Section 25(i-b)(a) 26/35 of the Arms Act. The petitioner's prayer for grant of regular bail was earlier rejected twice by applying Section 37 of the NDPS Act. Learned Senior Counsel appearing on behalf of the petitioner has argued that till date trial has not at all progressed though the petitioner has remained in custody for two and half

Be that as it may, I am of the view that there is no changed circumstance for this Court to reconsider the petitioner's prayer for regular bail.

In the peculiar facts and circumstances, this application is disposed of with a direction to the court below to conclude the trial within one year from today. The prosecuting agency shall be under obligation to extend all cooperation for expeditious conclusion of the trial.
