Petitioner apprehends her arrest in Panjwara P.S. Case No.72 of 2018, registered under Sections 147, 149, 224, 225, 323, 332, 333, 353, 504 and 506 of the Indian Penal Code. The gist of the allegation is that the son of the petitioner was arrested in connection with Panjwara P.S. Case No.51 of 2018, registered under Sections 379 and 411/34 of the Indian Penal Code but the petitioner resisted and snatched the rifle of a Constable and also got her son freed from the custody of the police. In the meantime, many other persons such as Ramanand Yadav, Bikram Yadav, Gurudeo Yadav came and got the son of the petitioner freed from the custody of the police. Learned counsel for the petitioner submits that the petitioner is a lady. She has falsely been implicated in this case
Patna High Court Cr.Misc. No.75618 of 2018(2) dt.21-12-2018 2/2 on account of dirty village politics but on the face of it, it appears that the police arrested Akash Yadav, the son of the petitioner in a case registered under Sections 379 and 411/34 of the Indian Penal Code but the petitioner resisted the arrest of her son and tried to snatch the rifle from a Constable and also incited others to get her son freed from the custody of the police.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Jha, J) S.KUMAR/- U T
