JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-12-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Barauni (Zero Mile) P.S. Case No. 292 of 2018 for the offence under Sections 341, 323, 354, 307, 337, 427, 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. Referring to the prosecution case, he submits that there is no specific overt act alleged against the petitioner and the allegation made in the F.I.R. is general and omnibus.

Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand)

Patna High Court Cr.Misc. No.76953 of 2018(2) dt.21-12-2018 2/2 with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni (Zero Mile) P.S. Case No. 292 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
