The petitioner seeks regular bail in connection with Pirpainty P.S.Case No. 277 of 2017 instituted for the offence punishable under Sections 188, 272, 273 of the Indian Penal Code and 30 (A) of Bihar Excise Prohibition Amendment Act, 2016. The allegation is regarding recovery of 60 liters of illicit country made liquor from Auto rickshaw. Learned counsel for the petitioner submits that petitioner was only a passenger, who was sitting at the back seat of auto rickshaw. It is submitted that neither the petitioner is owner of the said auto rickshaw nor she was driver
Patna High Court Cr.Misc. No.59121 of 2017 (2) dt.22-12-2017 2/2 and she has got no criminal antecedent. Learned counsel for the petitioner submits that she is in custody since 05.10.2017. Considering the nature of accusation, period of custody undergone and clean antecedent, I deem it fit and appropriate to direct the release of the petitioner. Accordingly, the petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhagalpur in connection with Pirpainty P.S. Case No. 277 of 2017.
