JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-12-2014 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,379,504 and 506/34 of the Indian Penal Code. The accusation is of making assault, snatching jewellery and rupees ten thousand, taking signature forcefully on plain paper and outraging modesty.
It is submitted by learned counsel for the petitioners that no injury has been caused to the informant side. The petitioner no. 1 lodged Gaighat P.S. Case No. 89 of 2014 for the occurrence of 9.3.2014 and when the informant side got chargesheeted in the
Patna High Court Cr.Misc. No.45690 of 2014 (2) dt.24-12-2014 2/2 said case, the present case has been lodged. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Muzaffarpur in connection with Gaighat P.S. Case No. 255 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
