JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Rosera PS case no. 186 of 2017 instituted for the offences punishable under Section 30(A)/38 of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 32 ltrs of illicit liquor from the bushes.
The learned counsel for the petitioner submits that the petitioner was passing by the area from where, the alleged recovery has been made and he has got nothing to do with the alleged recovery. It is further submitted that the petitioner has clean antecedent and he is in custody since 25.07.2017.
Patna High Court Cr.Misc. No.59754 of 2017 (2) dt.22-12-2017 2/2 Considering the nature of accusation, clean antecedent and the period of custody undergone, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Addl. Sessions Judge-cumSpecial Judge Excise, Samastipur in connection with Rosera PS case no. 186 of 2017.
