The petitioner seeks bail in Parbatta P.S. Case No. 218/2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and 27 of the Arms Act.

The informant alleged that five persons including the petitioner came on a tractor. Niranjan Kumar armed with big firearm and others armed with small firearms came. Niranjan Kumar asked to plough the land but Laxman Kumar, son of the informant asked them not to plough the land. On such, Karelal Yadav fired which hit on the thigh of Laxman Kumar. Learned counsel for the petitioner submits that no allegation of firing is made against the petitioner. The petitioner is

Patna High Court Cr.Misc. No.48245 of 2016 (2) dt.23-12-2016 2/2 in jail since 18.09.2016 and the occurrence took place on 16.09.2016.

Considering the facts aforesaid and the fact that there is no allegation of firing against the petitioner, allegation of firing is made against Karelal Yadav, which hit on the thigh of Laxman Kumar, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Parbatta P.S. Case No. 218/2016.
