JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 22-12-2015 Petitioner apprehends arrest in a case under sections 363 and 366A of Indian Penal Code on the allegation that he along with one Praduman Bhakt enticed away 16 years old minor daughter of the informant.

The petitioner submits that the main allegation is against said Praduman Bhagat. He, referring to 164 Cr.P.C. statement of the victim, states that the girl has also made allegation against Praduman Bhakt.

Counsel for the State submits that on going through the FIR and the girl's statement under section 164 Cr.P.C., it appears that the petitioner has also played active role in enticing away informant's minor daughter.

In my view, if the petitioner surrenders and prays for regular bail, the same would be disposed of preferably on the

Patna High Court Cr.Misc. No.50836 of 2015 (3) dt.22-12-2015 same day on its own merit without prejudice.

The bail petition is thus disposed of.
