The application is for grant of bail for the offence under Sections 25 (a-b)a of the Arms Act.
It has been submitted on behalf of the petitioner that he has been falsely implicated in this case and even from perusal of the FIR, it will appear that the case was lodged by the wife of the petitioner under Section 498A of the Indian Penal Code. It has further been submitted that one Katta without any cartridge was recovered from the house of the petitioner. It has also been submitted that actually the petitioner has been falsely implicated in this case and he is in custody since 26.07.2016. Heard learned A.P.P. also.
Having heard both sides. In view of the fact that the
Patna High Court Cr.Misc. No.55445 of 2016 (2) dt.23-12-2016 2/2 petitioner is in custody for about five months in this case, let petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar, Judicial Magistrate Ist Class, Bikramganj, District- Rohtas in connection with Natwar P.S. Case No.59 of 2016.
