Petitioner is accused in connection with Sirdala (Meskaur) P.S. Case No. 04 of 2015 registered under Sections 25(1-B)A/26 of the Arms Act.

The accusation is of recovery of one country made pistol and one live cartridge from the house of the petitioner. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that the alleged country made pistol and live cartridge are not recovered from the possession of the petitioner and the petitioner was not apprehended by the police in course of search of his house rather petitioner has surrendered on 30.07.2015 and since then he is in

Patna High Court Cr.Misc. No.51917 of 2015 (3) dt.22-12-2015 2/2 custody. It is further submitted that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-5th, Nawada in connection with Sirdala (Meskaur) P.S. Case No. 04 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
