Taking into consideration that petitioner was present on the place of occurrence and had kept vigil over the activities of other accused, who had committed gang rape, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Bihta P.S. Case No. 678 of 2015 pending in the court of 1st Additional Sessions Judge-cum-Special Judge (POCSO), Patna stands rejected.
