JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 2 24-12-2013 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case for the offence under Section 376 of the Indian Penal Code. The petitioner submits that allegation of rape is against his son Md. Shahbaz. He even has agreed to meet the expenses of miscarriage. The State submits that petitioner has gone back on his promise to settle the marriage of the victim with his son. As there is no allegation of rape against the petitioner, in the event of arrest or surrender before the court below within four weeks from today the above named petitioner be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case no. 224 of 2011 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
