JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-12-2013 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Habibpur P.S. Case No. 47 of 2013 registered for the offences punishable under Sections 419, 420, 467, 468, 469, 471, 406/34 of the Indian Penal Code.
The petitioner was junior engineer at the relevant time and the allegation against him is that he gave false measurement report in connection with execution of government scheme.
The submission on behalf of the petitioner is that in course of enquiry, it came to light that sub standard materials were used by the contractor in construction of drainage and the aforesaid contractor has already been admitted to anticipatory bail
Patna High Court Cr.Misc. No.39562 of 2013 (2) dt.24-12-2013 by this Court. It is further submitted by him that when B.D.O. made an enquiry on 11.12.2009, he found that petitioner had made proper entry in the measurement book.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Habibpur P.S. Case No. 47 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) SHAHZAD/-
