Petitioners apprehend their arrest in Shambhuganj P.S. Case No.209 of 2018, registered under Sections 341, 323, 379,
Patna High Court Cr.Misc. No.75617 of 2018(2) dt.21-12-2018 2/2 307, 435 and 448/34 of the Indian Penal Code. The informant alleged that at about 4.00 in the morning on 13.09.2018, the wife of Nezam was mixing poison in the fodder of the buffalo but in the meantime, the informant snatched that packet of poison from the hand of wife of Nezam. On such, the petitioners and other accused persons ransacked the entire house of the informant, set ablaze the cattle shade and also took away different articles from the house of the informant.
Learned counsel for the petitioners submits that there is omnibus and general allegation but it appears that on petty dispute, the petitioners and other accused persons ransacked the house of the informant and also took away different articles thereafter they set ablaze the cattle shade of the informant. Considering the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioners is rejected.
