Petitioner is apprehending his arrest in connection with a case registered for the offences under Sections 385, 387 and other allied Sections of the Penal Code and Section 27 of the Arms Act. He is said to have demanded the extortion amount at the house of an M.L.A. of the ruling party from those who were present in the house of the M.L.A. Though M.L.A. himself was not present in the house at the time of occurrence. From the contents of the First Information Report, it is evident that petitioner was present at the spot. It is then submitted that petitioner is resident of the constituency of the M.L.A. and has been falsely implicated as a portion of his residential house in the village was let out to another political party. It is also submitted that uncle of the petitioner has lodged a complaint against the M.L.A. that he has made encroachment on the public land.

Patna High Court Cr.Misc. No.28877 of 2013 (3) dt.24-12-2013 Let petitioner, named above, surrender in the court below within four weeks from the date of receipt/production of a copy of this order in the court below in connection with Kotwali P.S. Case No. 38/2013 and apply for regular bail on the grounds urged in support of the present petition. With the aforesaid observation, the application is disposed of.
