JUSTICE SANJAY PRIYA ORAL ORDER 22-12-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Digha P.S. Case No. 30 of 2016, G.R. No. 652 of 2016 instituted for the offence under Sections 419, 420 and 379 of the Indian Penal Code.

It is stated in paragraph-8 of the bail petition that process under Sections 82 and 83 Cr. P.C. has been issued against this petitioner.

Learned counsel for the petitioner has submitted that compromise petition has been filed in the court below. Since process under Sections 82 and 83 Cr. P.C. has been issued against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

Patna High Court Cr.Misc. No.62491 of 2017 (2) dt.22-12-2017 Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be disposed off by the court below in accordance with law without being prejudiced by this order.
