Patna High Court Cr.Misc. No.62262 of 2018(4) dt.21-12-2018 2/3 ORAL ORDER 21-12-2018 Heard learned counsel for the parties.

Petitioner seeks bail in Daniyawan P.S. Case No. 68/2018 registered for the offence punishable under Sections 20/22 of the N.D.P.S. Act.

As per allegation, the police apprehended the petitioners along with co-accused Upendra Rai, Soni Devi and Chootu Chauhan on the spot on getting confidential information that in the rented house of Rajni Devi which belongs to one Satyendra Gope situated at Daniyawan Bazar, some objectionable material was brought by some persons in a bag. On search, altogether 102.1 k.g. Ganja in different plastic bags has been recovered from the said rented house whereas one mobile each has been recovered from accused persons including the petitioners.

It appears that petitioners are named in the F.I.R. and from the rented house of Rajni Devi where all the petitioners were present, 102.1 Kg. Ganga kept in plastic bags has been recovered. The consumption, possession and selling of Ganga or any narcotic drug is illegal .

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioners on bail at this stage. Hence, the prayer for bail of the petitioners is hereby rejected.
