Petitioner apprehends her arrest in a case registered for the offence punishable under Sections 363 and 366A/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the story of kidnapping has been alleged in the First Information Report is absolutely false. He submits that as a matter of fact the girl who is alleged to have been kidnapped has married Dipu Yadav the co-accused who happens to be nephew of this petitioner. It has been submitted that said Sanju Kumari is not a minor as alleged in the First Information Report and she is more than 21 years of age.
Patna High Court Cr.Misc. No.47221 of 2013 (4) dt.24-12-2013 In view of the submission as above, let petitioner Tetri Devi, in the event of her arrest/surrender within six weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in Kurtha P.S. No. 29 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
