This application is for grant of regular bail in connection with Special Case No. 15 of 2018 arising out of Case No. F.No.NCB/PZU/V11/2018 for the offence under Sections 8(C), 20 and 29 of the N.D.P.S. Act.
Allegation against the petitioner as per the FIR is about recovery of 137 Kg. Of Ganja from the BOLERO vehicle and the petitioner was arrested along with the other co-accused. Learned counsel for the Union of India opposed the prayer of bail.
Patna High Court Cr.Misc. No.54298 of 2018(4) dt.21-12-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this. He has no concern with alleged recovery and the said vehicle. He has no criminal antecedent and is in custody since 06.03.2018. Considering the amount of recovery of 137 kg. Ganja from the possession of the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.
