JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 21-12-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Barbigha P.S.Case No.459 of 2017 registered under Sections 307, 448, 323, 379, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Regard being had to the allegation that the petitioner no.1 opened fire and petitioner no.2 assaulted the informant by means of iron rod on the head causing injury as also the petitioners have got criminal antecedent, I am not inclined to grant them prearrest bail. Accordingly, the application for grant of pre-arrest bail

Patna High Court Cr.Misc. No.60671 of 2017 (2) dt.21-12-2017 2/2 is rejected.

In case the petitioners surrender and seek bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
