Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-12-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a complaint case punishable for offence under Sections 420, 406, 467, 468, 120(B), 323 of the Indian Penal Code.

3. As per prosecution case, the allegation against petitioner is that he offered the complainant and her husband for purchase of piece of land and in lieu thereof, petitioner took Rs. 4 lakhs in his hand from complainant and has given fake sale deed to the complainant. Petitioner is alleged to be witness of the alleged sale-deed.

4. Learned counsel for the petitioner submits that petitioner is neither vendor nor vendee of the sale-

Petitioner has not taken any money from the complainant. Petitioner has got clean antecedent and is in custody since 02.09.2024. Chargesheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran (Chapra) in connection with Complaint Case No. 617(C) of 2020.
