The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

From the motorcycle of the petitioner, 25 litres of country made liquor was recovered.

Considering the presumption under Section 32 of the Bihar Prohibition and Excise Act, 2016 and reverse burden of proof, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Special Case No. 7664 of 2019 arising out of Parsa Bazar Police Station Case No. 272 of 2019 pending in the court of learned Special Judge Excise Court, Patna. Hence, prayer for anticipatory bail of the petitioner is refused.
