JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-07-2026 The learned counsel for the opposite parties submits that in compliance of the order of this Court dated 26.09.2023, passed in CWJC No.2761 of 2023, the encroachment proceedings initiated vide Encroachment Case No.11 of 2021-22 was concluded by passing the final order under section 6(1) of the Bihar Public Land Encroachment Act, 1956 on 24.01.2022 by the Circle Officer, Rafiganj, which was challenged by the encroachers before the learned District Magistrate-cumCollector, Aurangabad in Encroachment Appeal Case No.77 of

Patna High Court MJC No.3970 of 2024(3) dt.31-07-2026 2/2 2022, however the same had also stood dismissed by an order dated 28.02.2025. Nonetheless, the same has been challenged by one of the encroachers before this Court by filing a writ petition bearing CWJC No.16054 of 2025, hence it is submitted that the petitioner may intervene in the said writ proceeding, if so advised.

2. I find that nobody has appeared for the petitioner to dispute the aforesaid aspect of the matter, hence I deem it fit and proper to dispose of the present contempt petition by granting liberty to the petitioner to avail such other remedies as are otherwise available under the law, including that of intervening in the aforesaid writ petition bearing CWJC No. 16054 of 2025.
