1. Heard learned counsel for the parties.
2. The petitioner has renewed his prayer for bail in connection with Arer P.S. Case no.117 of 2022 registered under sections 394 and 34 of the Indian Penal Code.
3. The earlier prayer for bail of the petitioner was rejected vide order dated 15.5.2023 passed in Cr. Misc. no.17818 of 2023.
4. As per the prosecution case, the petitioner and one another accused, who snatched the bag containing Rs.20,000/ from the possession of the informant and made an attempt to escape on a motorcycle, were caught with the stolen articles and assaulted.
5. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.83266 of 2023(2) dt.22-12-2023 2/2 earlier prayer for bail of the petitioner was rejected vide order dated 15.5.2023 passed in Cr. Misc. no.17818 of 2023 giving liberty to the petitioner to renew his prayer for bail after six months. The petitioner is in custody since 30.8.2022, chargesheet has been submitted in the case and it has been more than six months since the passing of the order dated 15.5.2023.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner, the petitioner having remained in custody for more than 1 year 3 months since 30.8.2022, chargesheet having been submitted in the case and liberty granted to the petitioner in the earlier order of rejection dated 15.5.2023, the Court directs the petitioner to be enlarged on bail in connection with Arer P.S. Case no.117 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Benipatti, District Madhubani.
