The petitioner in the present case is seeking a writ in the nature of Mandamus for directing the Respondents to release the Bolero Pickup Vehicle bearing Registration No. BR05GA5309, Engine No. GHF1F39389, Chassis No. MA1ZN2GHKF1F56171 which has been seized in connection with Simri P.S. Case No. 59 of 2025 on 04.04.2025 registered under Sections 30(a), 33 and 36 of Bihar Prohibition and Excise Act, 2016 (as amended up to date).

Having regard to the fact that the petitioner has not approached the competent authority in terms of Rule 12A of the Bihar Prohibition and Excise Rules, 2021 (as amended up to date), we permit learned counsel for the petitioner to withdraw this writ application and avail his remedy in accordance with law.
4. If a proposal in Form IV is filed for release of the vehicle in question, the same shall be considered and decided within a period of one month from the date of filing of the same. Since this Court has been informed that the vehicle is stolen vehicle, learned counsel for the petitioner shall produce the judgment of this Court rendered in the case of Bimlesh Kumar Vs. The State of Bihar and Others (CWJC No. 19659 of 2025) and in the case of Prashant Kishore Thakur Vs. The State of Bihar and Others (CWJC No. 14985 of 2025) before the competent authority who will look into the same and take an appropriate view of the matter.
