ABHISHEK REDDY ORAL ORDER 24-12-2025 Without going into the merits or demerits of the case, the present writ petition is disposed of at the stage of 'Admission' with the consent of both the counsels.

2. Learned counsel for the petitioner submits that initially the petitioner has applied for grant of N.P. Bore Revolver/Pistol before the District Magistrate and the District Magistrate vide order dated 30.12.2023 in Memo No. 4451 has rejected the application made by the petitioner. That thereafter the petitioner aggrieved by the orders of the District Magistrate, Patna has preferred an Arms Appeal No. 26 of 2024 before the

Patna High Court CWJC No.19680 of 2025(2) dt.24-12-2025 2/3 Divisional Commissioner, Patna (Respondent No. 2) and the Divisional Commissioner vide order dated 14.05.2024 has set aside the order of the District Magistrate and remanded the matter back for fresh consideration. Learned counsel submits that though the matter was remanded wayback on 14.05.2024 the District Magistrate, Patna i.e. the Respondent No. 3 till date has not passed any orders on the application made by the petitioner after the remand order of the Divisional Commissioner. Learned counsel submits that a direction may be given to the Respondent No. 3 to pass necessary orders on the application made by the petitioner pursuant to the order of remand passed by the Divisional Commissioner dated 14.05.2024 by fixing a time frame.

Learned counsel appearing on behalf of the respondent State submits that he has no objection if a direction is given to the Respondent No. 2 to pass necessary orders strictly in accordance with law pursuant to the remand order passed by the Divisional Commissioner in Arms Appeal No. 26 of 2024 dated 14.05.2024.

4. Having regard to the same, the present writ petition is disposed of directing the Respondent No. 3 to consider the application made by the petitioner dated 19.09.2024 (Annexure-

Patna High Court CWJC No.19680 of 2025(2) dt.24-12-2025 3/3 P/3) as expeditiously as possible preferably within a period of twelve weeks from the date of receipt of the copy of this order. It is needless to mention that before passing any order, the petitioner shall be given an opportunity of hearing. Any order passed shall be communicated to the party.

5. With the above direction, the present writ petition stands disposed of.
