The petitioner is in custody since 24.10.2019 in connection with Brahampur (Chakki OP) P.S. Case No. 310 of 2019 for the offence registered under Sections 30 (a) of the Bihar Prohibition and Excise Amendment Act 2018. Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but from the sumo victa which does not belong to the present petitioner and also from the courtyard of the petitioner where he was not present.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let
