2. Petitioner is seeking bail in connection with Mufassil P.S. Case 785 of 2025 registered for the offences under Section 30(a) of Bihar Prohibition and Excise Amendment Act.

3. As per FIR, 19 liters of country made liquor is said to have been recovered from the house of the petitioner.

4. Learned counsel for the petitioner submits that the seizure is said to have been made in absence of this petitioner, while this petitioner was not at home and the provision of BNSS has also not been adhered during preparation of seizure in question and on that basis, the petitioner was apprehended after about two months of the seizure. It has next been submitted that the petitioner has been in judicial custody since 17.10.2025.

5. Learned APP for the State vehemently opposed the

Patna High Court CR. MISC. No.89078 of 2025(2) dt.24-12-2025 2/2 prayer for bail.

6. Regard being had to the submission made by the parties and taking into consideration the period of custody of the petitioner, this Court is inclined to grant regular bail to the petitioner.

7. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No.-1, Gaya Jee in connection with Mufassil P.S. Case No. 785 of 2025. (Ajit Kumar, J) shailendra/- U T
