The petitioner has been in custody since 27.09.2019 in connection with Special Case No. 26/2019 (NDPS Act) arising out of Dagarua P.S. Case No. 183/2019 registered for the offence punishable under Sections 20/22/24 of the NDPS Act. Learned counsel for the petitioner submits that the vehicle of the petitioner was stopped and on search five small plastic packets of Brown Sugar weighing around 30 grams along with driving licence were recovered from the possession of the petitioner. Learned counsel for the petitioner further submits that no confessional statement or disclosure statement of the petitioner was ever recorded, but yet he is languishing in jail. It is next submitted that it has also not been ascertained that the substance so recovered was, in fact, intoxicant or narcotics as has been alleged.

No.84712 of 2019(2) dt.20-12-2019 2/2 Considering the recovery of the small quantity of narcotics substance and also because the petitioner has no criminal antecedents, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Session Judge cum Special Judge, Purnea, in connection with Special Case No. 26/2019 arising out of Dagarua P.S. Case No. 183/2019.
