JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 400,401,414/34 of the Indian Penal Code.

Stolen motorcycle was allegedly recovered from the house of the petitioner. Petitioner has got a criminal antecedent.

Considering the nature of allegation and material available on the record, in my view, this is not a fit case for grant of anticipatory bail. Hence, prayer is refused in connection with Rosera P.S.Case No.303 of 2019 pending in the court of learned A.C.J.M.-I, Rosera.

Patna High Court CR. MISC. No.84496 of 2019(2) dt.19-12-2019 2/2 Prayer for regular bail of the petitioner in the event of surrender shall be considered without being prejudiced by this order.
