The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.167/2017 registered in Police Station (Excise) Antarik, South Durg, Dist. Durg, for offence punishable under Section 34 (2), 36 of the Chhattisgarh Excise Act.

It is argued that the applicant is an innocent person. He is in detention since 26-11-2017. There is an allegation that the applicant is in possession of 58.500 bulk liters of illicit liquor.

Learned counsel appearing for the State would oppose the bail application.

Considering the facts and circumstances of the case; particularly considering the fact that the offence is triable by the JMFC; and also the fact that the applicant is in detention since 26-11-2017, this Court is inclined to release the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.20,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
