The appellant/petitioner was working as Assistant Grade-III in the office of Block Education Ofhcer, Dongargah, District Rajnandgaon. By an order dated 17.07.2012, he has been transferred to Government Girls

'

2% Higher Secondary School, Tilaikhar.

This order was challenged in a Writ Petition.

The Writ Petition was withdrawn with liberty to take recourse to other forum that may be available to the appellant. Thereafter, the appellant med a representation. The representation was dismissed. Then, again Writ Petition (S) No.3999/2013 was tiled.

The Writ Petition has been dismissed.

Hence, this appeal.

Mr. Dembra submits that though the appellant has been transferred to Government Girls Higher Secondary School, Tilaikhar, Block Dongargarh, District Rajnandgaon, but no such Institution is prevailing in the Block.

He further submits that it is on this account, the appellant has not been relieved till date and since July, 2012, he is getting regular pay 0%Lt'Y, y l from the offlce of Block EducationL-ongargarh. 3.

In view of the above submissions made by learned counsel for the appellant, we do not find any justification to pass any order on merits. 4.

The Writ Appeal is dismissed.
