1. By this revision the applicant has challenged the legality and propriety of the order dated 13.9.2005 passed by the Judidal Magistrate First Class, Ambikapur, Surguja, in Misc.Criminal Case No.62/04.

2. The present revision has been filed after 2913 days of its limitation.

3. After arguing the matter sometime, learned counsel for the applicant seeks to withdraw this revision with liberty to approach the revisional Court i.e. Sessions Judge.

4. The revision is dismissed as withdrawn reserving the aforesaid liberty. Stay application stands disposed of.
