1. This- is an application restoration of M.A.No.1529 of 1997, which was dismissed for want of prosecution vide order dated 20.4.2007 by the Division Bench.
2. As perAnnexure A/1, sole applicant Motilal Shrivastava died on 15.2.2000 i.e. before passing of the order in question, in these circumstances, present MCC in the form of restoration of MA dismissed for want of prosecution is not maintainable and dismissed as not maintainable reserving liberty to legal representatives to appellant Motilal Shrivastava to take appropriate steps may be under Order 22 Rule 9 of the Code of Civil 1~ Procedure. No order as to costs.
