This is the third bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.337/2020, registered at Police Station-Seepat, Bilaspur, District-Bilaspur (CG), for the offence punishable under Sections 21 and 22(b) of the NDPS Act. 2.

First bail application of the applicant has been dismissed as withdrawn on 11.12.2020 and second bail application has been dismissed on merits vide order dated 9.9.2021.

Learned counsel for the applicant would submit that there is inordinate delay in concluding the trial as the applicant is in jail since 21.7.2020 and as such, he is entitled to be released on bail on the ground of delay in trial.

A careful perusal of the order dated 9.9.2021 would show that this Court has already rejected the plea of delay in trial and that order has attained finality as it has not been shown to be challenged in any higher forum.

After hearing learned counsel appearing for the applicant and

after going through the records, I do not find any new ground or change in circumstance to entertain this third bail application. 6.
