The accused/applicant seeks regular bail in case FIR No. 357/2024 of PS Sagarpur for offence under Section 307/34 IPC. 2.

Broadly speaking, the allegation against the accused/applicant is that he inflicted stab injury on the victim Subhit in presence of the complainant de facto Suraj.

Learned APP for State, assisted by IO/SI Nitesh, accepts notice and in all fairness submits that the injured Subhit also now stands examined before the trial court, so State does not have serious objection to this application. 4.

The co-accused Vimal, who allegedly caught hold of the victim has already been granted bail this Court vide judgment dated 02.04.2026. It appears that the injured Subhit was earlier not appearing before the trial court to record his testimony but now he has been examined. The injured Subhit was discharged from hospital after 12 days of the incident dated 29.05.2024 and the accused/applicant is in custody since 30.05.2024. 5.

In above circumstances, this application is allowed and accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Trial Court.

A copy of this order be immediately transmitted to the concerned Jail Superintendent for informing the accused/applicant.
