The present petition has been filed under Article 226 of the Constitution of India seeking a direction to the Respondent, Municipal Corporation of Delhi (MCD) to maintain status quo qua any demolition action with respect to the flat of the Petitioner i.e., Flat No. A-30C, (First Floor) DDA Flats, Munirka, New Delhi-110067 in pursuance of the impugned order dated 18.12.2024 passed by the Assistant Engineer (Bldg.) South Zone, till 10.01.2025 so as to enable the Petitioner to file an appeal before the Appellate Tribunal, MCD.

The learned counsel for the Petitioner states that due to the intervening Court vacations, the Appellate Tribunal, MCD will start functioning from 03.01.2025. Mr. Kapil Dutta, learned Standing Counsel for the MCD states that the MCD does not intend to take any demolition action in pursuance to the impugned order dated 18.12.2024 until 08.01.2025. 4.
The statement of the learned Standing Counsel for MCD is taken on record and he is bound down to the same.

In view of the above, the petition is disposed of issuing a direction to the Petitioner to ensure the filing and listing of its appeal on or before 07.01.2025 before the Appellate Tribunal, MCD. 6.
With the aforesaid directions, the petition and application stand disposed of.
