Respondents (Respondents in-do-) Counsel for the Petitioner : Sri NANDURI SRIRAM Counsel for the Respondents : GP FOR STAMPS AND REGISTRATION Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Third Respondent to receive, register and release the Sale Deed executed in favour of the Petitioner herein, in respect of the property bearing Plot No.19, admeasuring 200 Square yards, in MCH Layout bearing part of Revenue Survey No. 7419, sltuated at East Marredpally, Secunderabad, pend.ing disposal of WP No. 5237 ol 2020, on the file of the High Court.
The court while directing lssue of notice to the Respondents herein to show cause as to why this application should not be complied wlth, made the following.(The receipt of this order will be deemed to be the receipt of notice in the case). ORDER:
Heard.
Learned counsel for the petitioner submits that in similar writ petitions being W.P.Nos.41282 ot 2018 and 29123 ot 2019, this Court has granted interim orders on 15.11.2018 and 09.01.2020 respectively in favour of the petitioners therein.
The said submission is not disputed by the learned Government Pleader. ln view of the same and considering the earlier orders passed by this Court in similar writ petitions, there shall be an interim direction to the 3'o respondent to receive and register the sale deed/gift deed/lease deed/settlement deed/mortgage deed/self declaration/will deed, etc. pertaining to petitioner's plot bearing No.19 admeasuring 200 Sq.yards. in MCH Layout bearing part of Revenue Survey No.7419, situated at East Marredpally, Secunderabad. However, it is made clear that the said registration is only a provisional one and will be subject to the outcome of W.P.No.19106 of 2010 filed by the State against the order of the Special Court under the A.P. Land Grabbing (Prohibition) Act, 1982, Hyderabad, in LGC No.167 of 1997 and batch.
It is also made clear that the petitioner shall not claim any equities in the event the present writ petition is dismissed or any adverse orders are pass in the W.P.No.19106 of 2010 filed by the State against the order of the Special Gourt underthe A.P. Land Grabbing (Prohibition) Act, 1982, Hyderabad, in LGC No.167 of 1997 and batch.
