HON'BLE SRI JUSTICE G. CHANDRAIAH AND HON'BLE SRI JUSTICE CHALLA KODANDA RAM R.C.No.140 OF 1997 ORDER:- (per Hon'ble Sri Justice G. Chandraiah) The present referred case is filed by the Commissioner of Wealthtax, A.P.-I, Hyderabad, raising the questions of law relating to the assessment year 1988-89.

2) When the matter is taken up for hearing, both the counsel submitted that the questions raised in the present referred case are required to be answered in favour of the assessee and against the revenue in view of the order dated 10.12.2013 passed by this Court in R.C.No.172 of 1996.

3) Recording the said submission of both the counsel, the referred case is disposed of answering the questions in favour of the assessee and against the revenue. No order as to costs. Miscellaneous Petitions, if any, pending in this referred case shall stand disposed of.

3) Let a copy of the order dated 10.12.2013 in R.C.No.172 of 1996 be tagged to the copy of this order.
