HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.28603 of 2010 ORDER:
This writ petition was filed seeking a direction to the respondents not to interfere with the petitioners' possession and enjoyment in respect of the land admeasuring Ac.16.94 1⁄2 cents situated at Seethanapalli Village, Kaikaluru Mandal, Krishna District, which were converted as fish tanks. It is their contention that they submitted an application on 08.01.2010 and 29.01.2010 and the respondents neither communicated the acceptance nor rejected their application.
The 3rd respondent filed a counter stating that the application of the petitioners was rejected on 01.04.2010 and 05.05.2010. The land of the petitioners is situated in the middle of huge extent of agricultural lands. In view of the rejection of their application, the deemed provision under G.O.Ms.No.18 dated 26.03.2008 is not applicable to their case. In the facts and circumstances of the case, the Writ Petition is dismissed, in view of the rejection of the application of the petitioners. However, the petitioners are given liberty to pursue appropriate remedies open to them under law. No order as to costs.
