O R D E R
This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused No.1 seeking to enlarge him on bail in connection with Crime No.102 of of Medipally Police Station, Malkajgiri Commissionerate. The offences alleged against the petitioner are punishable under Sections 103 (1), 238 read with 3 (5) of the BNS.

The case of the prosecution is that the de facto complainant lodged a report before police on 21.01.2026, wherein it is stated that his brother's sons Pandipati Bakkaiah and Srinivas are working with him in garbage lifting in Adibatla Area. As a routine work on 30.12.2025, Pandipati Bakkaiah left home and did not return home and his mobile phone also switched off. Hence, he requested the police to take necessary action against the said complaint. Basing on the same, initially police registered a case under 'Man missing' and on further investigation it was revealed that accused Nos.1 to 3 killed the said Pandipati Bakkaiah due to disputes in garbage and altered the section of law and registered the case for the aforesaid offences.

Heard Sri A.Abhinandhan Reddy, learned counsel for the petitioner/Accused No.1 and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent-State.

The contention of learned counsel for the petitioner is that the petitioner is innocent of the offences alleged against him and he was remanded to judicial custody on 02.04.2026 and since then he has been in jail;
that even after completion of 90 days, no charge sheet is filed by the respondent-police and on that ground also the petitioner is entitled for mandatory bail and hence, he prays this Court to grant regular bail to the petitioner. 5.
On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offences alleged against the petitioner are heinous and grievous in nature; that the evidence on record is sufficient to prove that the petitioner has committed the alleged offence, and hence, he requested the Court to dismiss the petition. However, he informed the Court that as on today no charge sheet is filed.

Considering the submissions made by learned counsel for petitioner and learned Additional Public Prosecutor, the petitioner has been in judicial custody since 02.04.2026. As seen from the record, L.Ws.1 to 19 were examined. However, no charge sheet is filed till date. Considering the period of incarceration and progress in investigation, this Court is inclined to grant bail to the petitioner-accused No.1 subject to the following conditions:
(i) The petitioner-accused No.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned Principal Junior Civil Judge-cumIV Additional Judicial Magistrate of First Class, Medchal-Malkajgiri District at Medipalli.
(ii) On such release, the petitioner-accused No.1 shall appear before the concerned S.H.O.
between 09:00 a.m., and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
(iii) The petitioner-accused No.1 shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS). 7.
Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
