THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27961 of 2008 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

This writ petition is filed declaring the action of the 4th respondent in not issuing fresh NOC in pursuance of the letter dated 01-12-2008 addressed by the 2nd respondent for grant of quarry lease in favour of the petitioner in respect of the land to an extent of Ac.5.00 in Sy.No.24 of Puligogulapadu Village, Addateegala Mandal, East Godavari District, as illegal and arbitrary.

This Court, by order dated 02.02.2009 directed the 4th respondent to conduct fresh enquiry and consider issuing fresh No-Objection Certificate for grant of quarry lease in favour of the petitioner in respect of land to an extent of Ac.5-00 in Sy.No.24 of Puligogulapadu Village, Addateegala Mandal, East Godavari District, and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order and communicate the same to the petitioner. Learned counsel for the petitioner submits pursuant to the said interim order, No-Objection Certificate was issued to the petitioner. In view of the same, no further orders are necessary in the present Writ Petition and the same is accordingly closed. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
