This Petition coming on for hearing,upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri B. KIRAN KUMAR , Advocate for the Petitioner and the Public Prosecutor (TG) on behalf of the Respondent.

The Court made the following: ORDER

HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.7024 0F 2020 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, lg73 (Cr.P.C.), is filed by the petitioners/AI arrd A-2, for grant of anticipatory bail in Crime No.376 of 2O2O of P'S. A.J. Mills Colony, Warangal Commissionerate, registered for the offence punishable under Section 306 read with Section 34 of the Indian Penal Code' Heard the learned counsel for the petitioners/Al and A-2, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

In the FIR, il-is inter alia stated that on O4'12'2Q2O the de facto complainant gave a complaint stating that the petitioners/A-1, A-2 and one another threatened her husband namely Madishetty Satheesh, the deceased, and harassed him demanding to return the borrowed amounts besides forcibly taking the house documents from him' The deceased felt insulted and got vexed on his life and consumed pesticide and succumbed to death while undergoing treatment' Hence, the complaint.

Learned counsel for the petitioners/Al and A-2 would submit that the petitioners are innocents and they are no way concerned with the alleged offence. The petitioners/A1 and A-2 are law-abiding citizens and are prepared to abide by any condition which this Court may deem fit to impose in case of

granting anticipatory bail. Hence, he prayed to grant anticipatory bail to the petitioners/A1 and A-2. Learned Additional Public Prosecutor representing the respondent-State opposed to grant anticipatory bail to the petitioners/Al and A-2.

As seen from the contents of the F.I.R., there are specific aliegations against the petitioners/Al and A-2 that they harassed the deceased by demanding to return the borrowed amounts and forcibly took the house documents from him and on that insult, the deceased consumed pesticide and died.

Having regard to the facts and circumstances of the case, nature and gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioners/Al and The Criminal Petition is, accordingly, dismissed. Miscellaneous applications, if any, pending shall stand closed.
