THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.16192 of 2014 ORDER :
The petitioner, who is accused No. 2 in Crime No.206 of 2014 of Gopalapatnam Police Station, Visakhapatnam, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with the above crime registered for the offences punishable under Sections 468, 471, 420 r/w 511 IPC.
The case of the prosecution is as under:
The officials of the Axis Bank lodged a report stating that A.1, who is the customer of their bank vide Savings Account No.912010033726615, sent a cheque bearing No.304267 dated 09.09.2014 for Rs.3,02,52,798/- drawn on State Bank of India for collection. When presented, the said cheque was returned for the reason that the said cheque was a fraudulent one. After return of the cheque, as it is a high value cheque, the bank officials contacted A.1 on his registered mobile No.9848388562. Then, A.1 stated that he was doing business in mines and towards pending dues, he received the said cheque from Mines Department. It is alleged that the said mobile number belongs to the petitioner herein who was also a customer of the Axis Bank. Basing on these allegations, the above report came to be lodged. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
The averments in the report would disclose that A.1 made an attempt by depositing a fake cheque for crores of rupees into his account with the registered mobile number of the petitioner. Having regard to the gravity of the offences and as the case is still at the stage of investigation, I am not inclined to consider the request of the petitioner for grant of anticipatory bail at this stage. Accordingly, the Criminal Petition is dismissed. However, the petitioner is at liberty to renew the request at an appropriate stage, if there is no material against him.
